MANILA, Philippines — May hurisdiksyon ang International Criminal Court (ICC) sa kasong crimes against humanity ni dating Pangulong Rodrigo Duterte.

Pahayag ito ni dating Vice President spokesman at UP criminal law professor Atty. Barry Gutierrez matapos kuwestyunin ang ginawang pag-aresto kay Duterte dahil kumalas na ang Pilipinas sa ICC noong 2019.

“So dahil nga ‘yung mga akusasyon laban kay dating pangulong Duterte ay supposedly nangyari mula 2011 hanggang 2019, ‘yung iba habang siya ay mayor ng Davao City, ‘yung iba habang siya ay nahalal na pangulo ng ating bansa, ayon mismo sa treaty pasok ‘yan sa jurisdiction ng ICC,” pahayag ni Gutierrez.

Ipinunto ni Guiterrez ang Pangilinan vs Cayetano na isinampa sa Supreme Court kung saan hiniling ng mga petitioners na ideklarang invalid at ineffective ang pagkalas ng Pilipinas sa ICC dahil wala hindi naman ito inaprubahan ng two-thirds ng Senado.

“Ang sabi ng Supreme Court, kahit hindi na ­naming pwedeng bawiin ‘yung desisyon ni Pangulong Duterte na umalis sa ICC, dinedeklara namin na yung mga nangyaring krimen habang tayo ay miyembro ng ICC, pwede pa ring isampa pa sa harapan ng international tribunal. Hindi na ICC ‘yan, hindi na treaty na panlabas, mismong ang Supreme Court nating kinilala ‘yan,” ani Gutierrez.

Ayon kay Gutierrez, nakasaad sa Section 17 ng Republic Act 9851, ang International Humanitarian Law na may awtoridad ang gobyerno sa crimes against humanity.
