Court of Appeals junks Alice Guo’s bid for freedom

MANILA, Philippines — The Court of Appeals (CA) has denied former Bamban, Tarlac mayor Alice Guo’s appeal to be released from prison.
Guo, a suspected Chinese spy convicted of qualified human trafficking, has argued that the Bureau of Immigration (BI) had unlawfully arrested her.
In its Oct. 5 ruling, the appellate court’s former First Division reiterated the “simple and inescapable fact” that Guo “is not under detention by the BI.”
“She is detained not by virtue of any warrant or order by the BI, but by the Pasig City Regional Trial Court (Branch 167)’s joint decision,” the appeals court maintained.
“There is neither allegation nor showing that such detention violated the petitioner’s constitutional rights to speedy trial and to liberty,” the CA added.
Guo is being held at the Correctional Institution for Women in Mandaluyong.
