100 minutes break

NAGREKLAMO sa akin si Lani, isang working mother, dahil pag lumalampas daw ng isang oras ang kanyang lunch break ay ibinabawas ito sa kanyang suweldo. Gusto niyang malaman kung tama ang ginagawang pagkaltas ng kanyang employer sa suweldo niya.

Kaya raw lumalampas ng 60 minuto ang kanyang lunch break dahil nagtatabi siya ng breastmilk para sa kanyang baby na ipinadadala niya sa kanilang bahay na hindi kalayuan sa kanyang pinaglilingkurang opisina. Kinukuha ito araw-araw ng kanyang nakababatang kapatid.

Dapat malaman ni Lani ang isinasaad sa Republic Act No. 10028 (Expanded Breastfeeding Promotion Acf of 2009).

“Section 7. A new Section 12 is hereby added to read as follows:

“Sec. 12 Lactation Periods. Nursing employees shall be granted break intervals in addition to the regular time-off for meals to breastfeed or express milk. These intervals, which shall include the time it takes an employee to get to and from the workplace lactation station, shall be counted as compensable hours worked. The Department of Labor and Employment may adjust the same: Provided, that such intervals shall not be less than a total of 40 minutes for every 8-hour working period.”

Malinaw sa batas Lani, na kailangang bigyan ka ng iyong employer ng karagdagang 40 minuto para sa lactation period.

Sana ay mabasa rin ito ng ibang mga employer para bigyan nila ng kabuuang 100 minuto sa bawat araw ang kanilang mga empleyada na kapapanganak at kailangan ng kanilang mga baby ang gatas.

Inuulit ko, walang karapatan ang employer na bawasan ng suweldo ang isang working mother na lumampas sa 60 minuto ang break dahil dapat ang mga nagpapasusong ina ay bigyan ng karagdagang 40 minuto na extra break kada isang araw.
