Why vp Binay must face his plunder case

SHOOTING STRAIGHT - Bobit S. Avila - The Freeman

Last Tuesday at the 888 News Forum at the Marco Polo Plaza, Atty. Rene Bondal came to expose the corruption of Vice President Jejomar Binay in that parking building that he had constructed for the City of Makati that was allegedly overpriced at P400 million. Of course we learned that the Commission on Audit   in Makati cleared VP Binay on this issue. But then no one went into a deeper investigation on this case.

Remember, we are in the midst of the biggest corruption scandal despite the presence of COA and therefore we can say no thanks to them. We are thankful that we have whistle blowers in our midst that exposed the corruption of our political leaders. So it is not beyond VP Binay that he should face plunder charges on the construction of that parking building.

But what really caught my attention is the other case that Atty. Bondal exposed… that the City of Makati bought mini-cabs or multi-cabs or secondhand Suzuki mini-cabs at P230,000 each. Now ask yourselves, especially those of our readers who recently purchased those secondhand mini or multi-cabs? How much did you buy them from the importer? I'm willing to bet that it's not even over a hundred thousand pesos each… and I would like to believe that this number is even high.

So let the hammer of Justice fall on the corrupt! If it falls on VP Binay, then he has the right to defend himself from such accusations. But telling the nation that this case was "politically motivated" is a weak defense. He must prove that the parking building wasn't overpriced and those mini-cabs were not overpriced. I'm glad that Atty. Bondal came to the 888 News Forum because he comes from Makati and since VP Binay is seeking to be the next President, we should all be aware of the things that he is doing in Makati.

As we already pointed out, because the Supreme Court  in a 13-0 decision declared the Disbursement Acceleration Program as unconstitutional, all of the sudden the dogs of the Aquino Regime in the House of Representatives, notably Rep. Neil Tupas of Iloilo who chairs the House Committee on Justice, held a congressional investigation on the Judicial Development Fund.

This case is obviously a no-brainer! If the SC tried to please Pres. Aquino and declared the DAP as constitutional, the SC would be liable for violating the 1987 constitution. Naturally, the SC did what it was created to do… to be the guardians of the Constitution. But then, Rep. Neil Tupas is blinded by his canine loyalty for Pres. Benigno Aquino III, so he has began his investigation of the JDF.

Of course, SC Chief Justice Ma. Lourdes Sereno was invited by the House Committee on Justice, but in that first hearing a couple of days ago, she did not appear. So Rep. Tupas went to town to charge the Chief Justice with snubbing this Congressional hearing saying, "We just want to help the SC to be accountable to the people, whether this is an initial hearing or not."

Wait-in-minute! Did I hear a huge clamor by the Filipino people who are marching in the streets in protest to have the JDF investigated? Listen in on what people talk about in the coffeehouses and you will hear people asking PNoy to be transparent about his DAP. But what we are seeing is a classic PNoy vengeance character. He already had former Chief Justice Renato Corona impeached, using his dogs in the Legislature. Now he is doing it again…using the same dogs to push the SC Justices to the wall.

But a puny congressman, even if he is the chairman of the House Committee on Justice cannot just summon the Chief Justice of the Supreme Court to the Congressional hearing for the simple reason that the Judiciary is not under the control of the Legislative Branch. But then, Rep. Neil Tupas doesn't understand these things, which is why he sounds like the slave of Pres. Aquino who belongs to the Executive Branch of the Philippine government and therefore it should be independent of the Legislative branch.

Chief Justice Sereno did the right thing… that upon receiving the invitation of Rep. Tupas to appear before his Committee, the Chief Justice sent her reply letter to House Speaker Feliciano Belmonte, Jr. saying among other things that the investigation was "premature and inappropriate." In writing directly to the House Speaker, CJ Sereno wrote to a co-equal head of their respective independent branches.

What the Philippines needs is a fresh change because the EDSA Revolution, which brought a change from the conjugal Marcos Dictatorship did not really change or transform this country into a better run country. While the EDSA Revolt restored Philippine Democracy after the Marcos Dictatorship threw out the 1935 Constitution, 28 years later, under the regime of Pres. Aquino, he has made a mockery of our Constitution, when he literally fused the Executive Branch with the Legislative Branch.
