Comelec commissioner ipinapa-DQ si Marcos; Partido ni BBM nais maparusahan si Guanzon
MANILA, Philippines — Ibinulgar agad ni Commissioner Rowena Guanzon ang kanyang boto para i-disqualify si dating Sen. Bongbong Marcos sa 2022 presidential elections kahit hindi pa binabasa ang pinal na hatol sa anak ng dating diktador — dahilan para hilingin ng isang partidong maparusahan ang nauna.
Huwebes kasi nang humarap sa GMA News si Guanzon para isapubliko ang kanyang opinyon pagdating sa mga petition laban kay Bongbong bago pa man magkaroon ng opisyal na promulgation, bagay na nakatakda sana noong ika-17 ng Enero.
"Comelec Commissioner Rowena Guanzon ILLEGALLY DISCLOSED AND LEAKED WITH UNDUE HASTE her vote to disqualify Senator Ferdinand 'Bongbong' Marcos Jr. in the Comelec First Division disqualification cases," galit na pahayag ni Partido Federal ng Pilipinas general counsel George Briones, Biyernes.
"BECAUSE OF HER PREMURE DISCLOSURE OR LEAKING of her UNPROMULGATED dissenting opinion, Commissioner Guanzon should be DISBARRED, WITH FORFEITURE OF HER RETIREMENT BENEFITS AND LIFETIME PENSION because she destroyed the reputation of the institution which these moneys come from."
Ang PFP ang partidong kinapapalooban ni Marcos. Giit ni Briones, paglabag sa Rule 3.07 ng Code of Judicial Conduct ang paglalabas agad ni Briones ng opinyon:
A judge should abstain from making public comments on any pending or impending case and should require similar restraint on the part of court personnel.
Bukod pa rito, lumalabag din daw si Guanzon sa Rule 2.02 ng Code of Judicial Conduct dahil sa pagiging "narcissist" at palagiang pagpapaskil sa Twitter na "hindi" raw akma para sa isang hukom.
'Unreasonable delay, hatol iniimpluwensyahan'
Ilan sa mga dahilan ni Guanzon sa paglalabas agad ng kanyang boto ay ang "unreasonable delay" ng Comelec First Division na maglabas ng desisyon. Hindi raw niya isisikreto sa publiko ang kanyang boto lalo na't nakita niyang may "moral turpitude" talaga batay sa ebidensya na magdidiin kay Marcos.
Matatandaang naghain ng disqualification case laban kay Marcos ang Akbayan Citizens’ Action Party at Bonifacio Ilagan ng Campaign Against the Return of the Marcoses and Martial Law dahil sa conviction ni Marcos dahil sa kabiguang maghain ng income tax returns ng apat na taon.
Isa ang moral turptide sa mga grounds sa disqualification ayon sa Section 12 ng Omnibus Election Code:
Any person who has been declared by competent authority insane or incompetent, or has been sentenced by final judgment for subversion, insurrection, rebellion or for any offense for which he has been sentenced to a penalty of more than eighteen months or for a crime involving moral turpitude, shall be disqualified to be a candidate and to hold any office, unless he has been given plenary pardon or granted amnesty.
Dahil dito, iginigiit ng petitioners na perpetually disqualified na sa paghawak ng public office si Marcos.
"Kaya nga ito nangyayari lahat eh dahil ang boto ko is DQ (disqualified) si Marcos Jr. Sa tingin ko may moral turpitude talaga based on evidence and the law. I will not keep it a secret. That is the reason why this is happening," paliwanag ni Guanzon kahapon.
"Parang unreasonable na yung delay. Ang kutob ko talaga may nakikialam na eh. May nakikialam na. Some people are trying to influence the commissioners. 'Yun ang ayaw ko."
Hindi pa rin lumalabas ang desisyon sa kaso ni Marcos kahit na limang araw na lang (ika-2 ng Pebrero) ay magreretiro na si Guanzon, dahilan para tanungin ng ilan kung bibilangin pa rin ang kanyang boto.

Maliban kay Guanzon, may dalawang commissioner pa sa First Division na humahawak ng Marcos case: sina Aimee Ferolino at Marlon Casquejo.
Pinangalanan ni Guanzon si Ferolino bilang ponente ng kaso.
Kwestyon sa objectivity?
Giit ng PFP counsel, ang maagang paglalabas ng opinyon ni Guanzon ay nagpapakita raw ng "personal niyang interes" sa kaso, lalo na't "susuportahan" daw ng komisyoner ang karibal ni Bongbong sa 2022 presidential elections na si Bise Presidente Leni Robredo.
"To the extent that she will forfeit her retirement benefits and lifetime pension to support the candidacy of vice president Leni Robredo who the petitioners in this case openly support speaks of how deep she (GUANZON) IS INTERESTED IN THIS CASE," sabi pa ni Briones kanina.
"COMMISSIONER GUANZON’S MAD RUSH TO COME OUT WITH A DECISION OF THE FIRST DIVISION BARES HER TRUE COLOR WHICH IS YELLOW. She has openly sided with for presidential candidate LENI ROBREDO who is the candidate of petitioners, by her UNDUE HASTE to come out with a decision resorting to ILLEGALLY LEAKING her minority opinion to the news media."
Hanggang sa ngayon, wala pang komento si Comelec spokesperson James Jimenez pagdating sa mga pahayag nina Briones at Guanzon.
