Here’s how workers should be paid on Ninoy Aquino Day, says DOLE

MANILA, Philippines — The Department of Labor and Employment (DOLE) issued guidelines for wage payments on Thursday, August 21.

In an advisory, DOLE outlined the rules for paying workers on Ninoy Aquino Day, which the government declared a special non-working holiday last year.

The following are the pay guidelines for the Ninoy Aquino Day:

  • For employees who did not work: The "no work, no pay" principle applies. However, this rule does not apply if a company has a policy or collective bargaining agreement (CBA) that provides for payment on that day.
  • For employees who worked for eight hours or less: The employee must be paid an additional 30% of their daily wage for the first eight hours of work. The computation is: (daily wage x 130%).
  • For employees who worked more than eight hours (overtime): The employee must be paid an additional 30% of their hourly rate for the day. The computation is: (hourly rate x 130% x 130% x number of hours worked).
  • For employees who worked on their rest day: The employee must be paid an additional 50% of their daily wage for the first eight hours of work. The computation is: (daily wage x 150%).
  • For employees who worked more than eight hours on their rest day (overtime): The employee must be paid an additional 50% of their hourly rate for the day. The computation is: (hourly rate x 150% x 130% x number of hours worked).
