ALPAP pinagbabayad ng danyos sa PAL

MANILA, Philippines - Pinagbabayad ng Court of Appeals (CA) ang Airline Pilots Association of the Philippines (ALPAP) sa Philippine Airlines ng mahigit P730 milyong danyos dahil sa iligal na pagsasagawa ng strike na nagparalisa sa international at domestic operations ng nasabing airlines noong taong 1998.

Ito ay sa inilabas na kautusan ng CA’ Thirteenth Division na nagbaligtad sa February 26, 2010 ruling ng National Labor Relations Commission (NLRC) na nagbasura sa complaint for damages na inihain ng PAL dahil sa umano’y ‘lack of jurisdiction and prescription’.

Sa 26-pahinang desisyon sa panulat ni Associate Justice Ramon Cruz,

iginiit ng CA na umabuso ang NLRC sa naging kautusan nito na nagdeklarang ‘prescribed’ na ang kaso.

Pinaburan rin ng CA ang argumento ng PAL na maari lamang silang mag­hain ng danyos sa iligalidad ng ALPAP strike kung naisapinal na ng

Korte Suprema ang hatol sa June 1998 ALPAP strike dahil kung agad umanong naghain ng danyos ay maituturing na premature, na sa huli ay maidedeklarang ‘groundless’.

“The Supreme Court decision resolving the illegality of the strike attained finality only on August 29, 2002. It was only then that private respondents’ act of abandoning their aircrafts had been declared illegal and hence, they could already be held culpable for

causing injury to petitioner’s business, assu­ming such could be proven

by the petitioner,” bahagi ng kautusan ng CA.
