Recom tagumpay sa Comelec
MANILA, Philippines - Pinaboran ng Commission on Election (Comelec) si Caloocan City Mayor Enrico “Recom” Echiverri matapos balewalain ang isinampang kaso laban dito ni dating Mayor Macario “Boy” Asistio, Jr. hinggil sa umano’y paglabag sa “fair election act”.
Sa 11-pahinang en banc resolution na inilabas ng Comelec, pinaboran ng mga ito ang inihaing motion for reconsideration ni Echiverri upang balewalain ang unang inilabas ng law department na maaaring sampahan ng kaso ang alkalde sa paglabag sa Fair Election Act.
“Wherefore, in view of the foregoing, the motion for reconsideration is hereby granted. Accordingly, the resolution date January 28, 2001 is reversed and set aside,” nakasaad na bahagi sa inilabas ng Comelec en banc resolution.
Sa inihaing motion ng kampo ni Echiverri, hiniling nito sa Comelec na ibasura ang naunang resolusyon na inilabas noong January 28, 2011 dahil wala namang “probable cause” ang inihaing reklamo.
“The purported campaign materials are not individual posters of the respondent (Echiverri) but rather common posters of all candidates belonging to his political party;
“The findings of the Commission are based on mere assumptions and surmises; The purported campaign materials are located in private properties; The campaign materials were set up in private properties with the consent of the owners thereof; and the election officer of Caloocan City did not issue any notice or order directing the respondent or any candidate belonging to his political party to remove any illegal election campaign material,” nakasaad sa mosyon.
Bilang suporta sa mga nabanggit na paliwanag ay nagsumite ang kampo ni Echiverri ng affidavits ng mga may-ari ng private properties kung saan inilagay ang mga campaign material na inirereklamo.
Isang sertipikasyon din ang inilabas ng election officer ng Caloocan City na nagpapatunay na walang nilabag ang kampo ni Echiverri ng mga panuntunan sa Fair Election Act.
