Mining company wala mobayad og buhis?

CEBU, Philippines — Gihimakak sa Philippine Mining Services Corporation (PMSC) nga nagbase sa Lungsod sa Alcoy ang pasangil nga wala sila makabayad og buhis ngadto sa Probinsiya sa Sugbo

Ang PMSC niluwat kini og pamayag niadtong Marso 1, 2023 diha sa ilang website nga nagkanayon nga lehitimo kini nga kompaniya nga nag-operate sulod na sa 40 ka tuig ug nisubay sa national ug lokal nga balaod.

“It is highly regretful that Philippine Mining Service Corporation (PMSC) was issued the executive order directing it to cease and desist from processing, selling, and transporting dolomite due its alleged violation of local tax laws and regulations and environmental laws”, matud sa PMSC.

Ang PMSC niluwat og pamahayag human sa giisyu nga executive order sa Kapitolyo nga ipahunong ang pagproseso, pagbaligya ug transport sa dolomite sa ilang kompaniya tungod sa giingong kalapasan sa tax ug environmental laws.

Matud sa PMSC nga nakadawat sila og upat ka local tax assessments gikan sa Probinsiya sa Sugbo sukad niadtong Oktubre 2020.

"In accordance with and pursuant to the Local Government Code of the Philippines as well as the Revenue Code of Cebu, PMSC has timely protested the said assessments to the province. But since PMSC did not receive any reply from the province on the said protests, as mandated by applicable laws and jurisprudence, PMSC elevated the issue on the legality and validity of said tax assessments to the Regional Trial Court (RTC) of Cebu", matud sa PMSC diin pending ang maong kaso karon ngadto sa korte.

Gibutyag sa PMSC nga niadtong Enero 4, 2023 ang Kapitolyo niluwat og “notice of levy and auction sale” sa property sa PMSC diin ang maong kompaniya niduso dayon og "extremely urgent motion" alang sa Temporary Restraining Order (TRO) ug aplikasyon og writ of preliminary injunction.

"Since as far as it is concerned, PMSC is not and cannot be legally considered  as delinquent under the law as the tax assessments were duly and timely protested and are still pending with the RTC", padayag sa kompaniya.

Niadtong Pebrero 3, 2023 nakakuha ang PMSC og TRO ug writ of preliminary injunction niadtong Pebrero 23, 2023 gikan sa korte.

Ang Kapitolyo nimando sa PMSC nga mobayad sa 10 porsyento nga buhis gikan sa operasyon niini sa Lungsod sa Alcoy nga ubos sa hurisdiksiyon sa Probinsiya sa Sugbo. —/BDB (BANAT NEWS)
