'Mandatory' insurance, tax-free hazard pay sa journos inihain sa Kamara

MANILA, Philippines — Dahil peligroso ang pamamamahayag sa Pilipinas, nakahain ngayon sa Kamara ang panukalang magbibigay ng insurance, benefits at "tax-exempt" hazard pay sa lahat ng media workers — maparegular man, kontraktwal o freelancer.

Ito ang nakasaad sa House Bill 6543 ni Las Piñas Rep. Camille Villar, bagay na inihain noong Biyernes at isinapubliko ngayong Martes.

"Under this proposal, benefits are being extended to all permanent, temporary, contractual and casual journalists employed by media entities in the Philippines, as well as freelance journalists," ani Villar sa kanyang explanatory note.

Sa pag-aaral ng Reporters Without Borders na inilabas ilang araw pa lang ang nakalilipas, Pilipinas ang ika-apat na bansang may pinakamaraming journalists na namatay simula pa 2003 sa bilang na 107.

Nobyembre 2022 lang nang ibalita ng Community to Protect Journalists na ikapito ang Pilipinas pagdating sa bilang unsolved media killings.

Ang lahat ng ito ay nangyayari habang marami sa mga media workers ang mababa ang sahod, hindi regular sa trabaho o nakasailalim sa maanomalyang "talent system," kung saan maliit o halos walang benepisyo matapos ang ilang taong serbisyo.

"It is time that journalists deserve the respect not only for the type of work that they are doing but also in the form of benefits that are long overdue," dagdag pa ng mambabatas.

"While some may not enjoy decent wages, it is necessary that journalists enjoy these perks as they have families that rely on them."

Mga benepisyo sa panukala

Kung maipapasa ang HB 6543, kasama sa obligadong ibigay sa media workers ang:

  • P350,000 disability benefit sa lahat ng media practitioners na magtatamo ng total o partial disability (pansamantala man o permanente) habang ginagawa ang trabaho
  • P300,000 death benefits na mamamatay habang ginagampanan ang trabaho
  • reimbursement ng actual medical costs na hanggang P200,000 para sa lahat ng media practitioners na maoospital o kakailanganin ng medical assistance habang nagtratrabaho 
  • tax-exempt hazard pay na katumbas o hindi bababa sa 25% ng kanilang buwanang gross basic salary tuwing ide-deploy sa calamity affected areas, conflict areas, prison camps, mental hospitals, lugar na talamak ang sakit, lugar na nasa state of calamity o emergency, tinamaan ng pagputok ng bulkan, atbp. peligrosong lugar

"The media entity shall have the option of selecting the insurance company and shall be responsible for paying the insurance premiums for their journalists and employees," sabi pa ng panukala.

"The SSS and GSIS shall create a special insurance program for freelance journalists that shall include, among others, a coverage of risks incurred while working in war zones, conflict-stricken areas, and calamity affected places."

Ang mga benepisyong nabanggit ay hiwalay pa sa mga ibinibigay ng Social Security System sa ilalim ng Social Security Law (Republic Act 8282) at Government Service Insurance System (RA 8291).

Multa at kulong sa lalabag

Ilan sa mga ipagbabawal sa ilalim ng panukala ang:

  • pag-ayaw o kabiguan ng media entities na magbigay ng dagdag na insurance coverages
  • pag-ayaw o kabiguan ng media entities na magbigay ng hazard pay
  • pag-away ng insurance company na mag-enrol ng journalists at empleyado ng mass media entities, freelance journalists na nasa field assignment dahil sa kanilang trabaho
  • hindi pagsunod sa regulasyon ng GSIS, SSS at Public Information Agency dahil sa naturang panukala

"Any person who shall wilfully commit any of the prohibited acts... upon conviction, be punished by a fine not less than Three Hundred Thousand Pesos (P300,000.00) but not more than Five Hundred Thousand Pesos (P500,000.00) or imprisonment of not less than one (1) year but not more than six (6) years or both depending upon the discretion of the court," sabi pa ng panukala.

Kung maipapasa, kailangang konsultahin ng GSIS, SSS at PIA ang National Press Club, National Union of Journalists of the Philippines, Kapisanan ng mga Brodkaster ng Pilipinas, atbp. sa pagbabalangkas ng implementing rules and regulations nito.
