Hanggang 12 taong kulong vs 'child marriages' ganap nang batas sa 'Pinas
MANILA, Philippines (Updated 5:06 p.m.) — Tuluyan nang naisabatas ang noo'y panukalang magpapataw ng kulong at libu-libong pisong parusa laban sa mga pagkakasal sa mga menor de edad sa Pilipinas.
Ito ang kinumpirma ng Presidential Communications Operations Office, Huwebes, matapos itong mapirmahan ni Pangulong Rodrigo Duterte noong ika-10 ng Disyembre. Kikilalanin na ito bilang Republic Act 11596.

Sa ilalim ng bagong batas, pwedeng makulong ng hanggang 12 taon ang sinumang magdudulot, mag-aasikaso o magfa-facilitate ng child marriage.
Maliban pa 'yan sa multa na hindi bababa ng P40,000. Mas malala naman ang magiging parusa kung kamag-anak mismo ang pasimuno ng nasabing kasal — hanggang P50,000, malibansa pagkawala ng parental authority sa bata.
Ayon naman kay Gabriela Partylist Rep. Arlene Brosas sa hiwalay na pahayag kanina, magandang hakbang ito laban sa abuso at maagang pagbubuntis ng mga musmos, at pagpapalakas na rin ng proteksyon sa kabataang kababaihan.
"The legislation’s approval also comes a time when teenage pregnancy in the country is on an alarming rise amid the pandemic, with a child as young as 10 giving birth," ani Brosas.

Ayon sa Philippine Legislators' Committee on Population and Development (PLCPD), isa sa anim na Filipinas ang naikakasal bago pa man tumuntong ng 18-anyos.
Sinasabing ika-10 ang Pilipinas sa buong mundo pagdating sa "absolute number" ng child marriages at unions.
"Tagumpay ito ng lahat ng advocacy groups at organizations na nagtataguyod ng karapatan ng kababaihan at bata na mapagpasyang itinulak ang child marriage ban sa bansa," pagtatapos ng Gabriela legislator.
Muslim, katutubo sakop matapos isang taon
Kahit na inoobliga ng Family Code na 18 taong gulang pataas ang ikakasal, pinapayagan ng Islamic laws sa Pilipinas ang pagkakasal sa mga menor.
Ito ay alinsunod sa Article 16 ng Code of Muslim Personal laws of the Philippines, na nagsasabing okey lang ito basta't 15-anyos na ang lalaki o nagdadalaga na ang babae.
(1) Any Muslim male at least fifteen years of age and any Muslim female of the age of puberty or upwards and not suffering from any impediment under the provisions of this Code may contract marriage. A female is presumed to have attained puberty upon reaching the age of fifteen.
(2) However, the Shari'a District Court may, upon petition of a proper wali, order the solemnization of the marriage of a female who though less than fifteen but not below twelve years of age, has attained puberty.
Paliwanag ng PLCPD, magbibigay ang batas ng "one-year transitory period" bago tuluyang ipataw ang mga penalty provisions ng batas sa mga Muslim at katutubong komunidad.
Narito ang nasasaad tungkol diyan sa Section 11 ng batas:
"Within one (1) year effectivity of this Act, the NCMF and NCIP shall extensively undertake measures and programs in their respective jurisdictions to assure full compliance with this Act. During the transition period of one (1) year, the application of Section 4(a) and (b) and Section 5 of this Act to Muslim Filipinos and indigenous cultural communities/indigenous peoples shall be suspended."
Sa ilalim ng Section 8 (j) at (k) ng batas, oobligahin ang National Commission on Muslim Filipinos (NCMF) at National Commission for Indigenous People (NCIP) na isama sa kanilang programs of action ang pagtataas ng awareness ng mga katutubo mananampalataya ng Islam pagdating sa epekto ng child marriages sa "over-all health and development" ng mga bata.
Kakailanganin ding tiyakin ng NCMF at NCIP na natutupad ang batas habang mino-monitor at nire-report ang kaso ng child marriages na nangyayari sa mga komunidad na kanilang nasasakupan.
