CEBU, Philippines - After accidentally shooting himself inside the Sto. Niño barangay hall on Tuesday, barangay tanod Richard Pugoy may soon face criminal charges for not having the appropriate permits to possess or carry his firearm.
Pugoy, 33, who was on-duty at that time, accidentally shot himself while lying down to sleep on a bench inside the barangay hall.
The tanod’s 357 caliber revolver with serial number 022779, fell from the waistband of his pants and discharged hitting him in the back with the bullet exiting through his chest.
Though wounded, the victim told investigating policemen that his firearm was “licensed” by virtue of a mission order and a memorandum receipt which was reportedly issued to him.
Pugoy further said in an interview that he recently purchased his firearm.
Police Regional Office – 7 Deputy Regional Director for Operations Sr. Supt. Louie Opus told The FREEMAN that Pugoy will face criminal charges for violating the Firearms Law.
He said the tanod is also liable for illegal possession and carrying of firearms.
Opus clarified that the issuance of MOs and MRs have long been dead, adding that the Firearms Explosives Security Service Agency and Guards Supervisory Section (FESSAGS) are the only ones authorized to issue permits to posses firearms.
Opus explained that EO 122 has been recently amended, allowing only the Chief PNP to issue permits to carry firearms outside residence.
The tanod has clearly, according to Opus, violated the law which led him and the person who issued the MOs and MRs liable, adding this problem should be corrected.
Firearms owners should always have the necessary permit to posses and carry firearms outside residence, Opus said.
Cebu City Police Office homicide investigator SPO4 Alex Dacua is currently looking in to the incident. The police now has Pugoy’s firearm pending verification from the FESSAGS.
Once fully recovered, Pugoy will be asked to present the necessary license and registrations for his firearm.
Pugoy is currently recuperating at Cebu City Medical Center. - THE FREEMAN
