Dahil sa ‘immunity from suit’

MANILA, Philippines — Ibinasura ng Commission on Elections (Comelec) ang election offense cases na isinampa ng ilang grupo laban kina Pang. Ferdinand R. Marcos Jr. at Vice President Sara Duterte bunsod ng alegasyon nang umano’y pagtanggap ng campaign donations para sa May 2022 national and local elections mula sa government contractors.

Ayon kay Comelec chairperson George Erwin Garcia, ang dalawa ay inabswelto ng Law Department mula sa natu­rang kaso bunsod ng immunity from suit, dahil sa pagiging pinakamatataas na opisyal ng bansa.

“The doctrine called immunity from suit, that is related to what is called state immunity from suit. That is recognized as a principle that is stated in our Constitution,” anang poll chief.

“The president of the Philippines and also, based on the study of our Law Department, the vice president of the Republic of the Philippines, are representing the State. As such, there can be no suit filed against the state,” paliwanag pa ni Garcia.

Dagdag pa ni Garcia, ang paghahain ng kaso laban kina Marcos at Duterte, ay magreresulta sa paglabag ng Comelec sa Konstitusyon.

“Complaints have been filed against them. If we act on them, we will violate their immunity from suit,” aniya pa.

Sa kabila nito, nilinaw naman ni Garcia na ang kanilang desisyon ay hindi nangangahulugan na ang naturang kaso ay hindi na maaaring isampa kina Marcos at Duterte, sa sandaling matapos na ang kanilang termino sa Hunyo 2028.

“During the period of their tenure as president and vice president, they are immune from suits. But, of course, outside or after that, they can face investigations or ­charges,” aniya.

Noong nakaraang buwan, ilang grupo, sa pa­ngunguna ng poll watchdog na Kontra Daya, ang humiling sa Komisyon na magsagawa ng preliminary investigation laban kina Marcos at Duterte dahil sa umano’y paglabag sa Omnibus Election Code (OEC).

Ayon sa mga ­petitioners, sina Marcos at Duterte ay kapwa tumang­gap ng ipinagbabawal na campaign donations mula sa go­vernment contractors. Base sa Statement of Contributions and Expenditures (SOCE), si Hilot ay nagkaloob umano ng P20 milyong donasyon kay Marcos habang si Escandor naman ay nagkaloob ­umano ng P19.9 milyon kay Duterte.
