Maharlika Fund inakyat sa SC, pinadedeklarang unconstitutional
MANILA, Philippines — Ipinadedeklarang ‘unconstitutional’ ng Makabayan bloc sa Korte Suprema ang pagsertipika ni Pangulong Ferdinand Marcos Jr., bilang urgent sa panukalang paglikha ng Maharlka Investment Fund (MIF) na naglalayong matugunan ang public emergency o kalamidad sa bansa.
Nitong Lunes ay naghain ng petisyon ang Makabayan bloc sa Korte Suprema na hiniling na ideklarang unconstitutional at walang bisa ang pag-apruba ng Kamara sa huli at pinal na pagbasa sa House Bill (HB) 6608 o ang MIF noong Disyembre 15, 2022.
“The petitioners are not asking for the President to be powerless in the face of public emergencies or calamities. Rather, we are seeking for the exercise of a power that would infringe on the constitutional duties and processes of Congress to be exercised only when a clearly defined emergency or calamity requires the curtailment of these processes”, giit ng mga ito.
Kinukuwestiyon din ng Makabayan bloc kung bakit sinertipikahang urgent ang MIF Bill na tanging para sa Kamara lamang at walang kaparehong sertipikasyon para sa Senado.
“The term “public emergency” or “calamity” was not mentioned in the certification, nor was its existence explained by the House leadership during the deliberation”, ayon pa sa Makabayan bloc.
