Search warrant na inisyu ng executive judge pwedeng gamitin nationwide -- SC

MANILA, Philippines — Nilinaw ng Korte Su­prema na legal at ma­aaring gamitin nationwide ang search warrants na inisyu ng exe­cutive judges ng Manila at Quezon City.

Ginawa ni Supreme Court spokesperson Atty. Brian Keith Hosaka ang paglilinaw bunsod ng pagsalakay ng militar at pulisya sa tangga­pan ng Bagong Alyan­sang Makabayan (Bayan­), Kilusang Mayo Uno, Anak­pawis, Gabriela, at National Federation of Sugar Workers sa Negros Occidental.

Ayon kay Hosaka, inatasan, ni Chief Justice Diosdado Peralta ang Court Administrator na paalalahanan ang mga judges na maging makatwiran at naaayon sa batas matapos na hilingin ni Bayan Muna chair Neri Colmenares sa SC na pag-aralan ang pag-iisyu ng warrant.

Ang naturang warrant ay inisyu ni Executive Judge Cecilyn Burgos-Villavert ng Quezon City Regional Trial Court Branch 89.

Giit ni Hosaka, ayon sa Court Administrator awtorisado ang Executive Judges ng Manila at Quezon City na mag-isyu ng SW alinsunod sa requirements.

Ang mga regional trial court judge naman ay mag-iisyu para lamang sa kanilang nasasakupan.

“If respondents feel aggrieved with the issuance, the proper remedy­ is to file a motion to quash either before the court that issued them, or before the court where the cases are eventually filed,” ani Hosaka.

Nabatid na umaabot sa 57 aktibista ang di­na­kip matapos ang pagsalakay ng Philippine National Police at Philippine Army.
