PNoy hindi dapat kasuhan sa DAP - DOJ

MANILA, Philippines – In good faith o maganda ang hangarin ni Pangulong Benigno Aqiuino III sa Disbursement Acceleration Program (DAP) kaya naman hindi siya dapat makasuhan, ayon kay Justice Secretary Alfredo Benjamin Caguioa ngayong Huwebes.

Sinabi ni Caguioa na wala dapat maging pananagutan si Aquino sa DAP ngunit inamin niyang sa panahon ngayon ay malaki ang tsansa na makasuhan ang Pangulo.

"As a matter of law and my appreciation of law and the facts as I know them I don't believe he should be charged precisely because of the fact doctrine and good faith,” wika ni Caguioa.

“I don’t think he should be charged but in today's world, he probably will,” dagdag niya.

Ito ang sinagot ni Caguiao sa katanungan ng Judicial Bar Council (JBC) kung saan isa siya sa mga nangangarap na maging Supreme Court Associate Justice kapalit ni Associate Justice Martin Villarama Jr.

Iginiit pa niya na hindi pasok sa kategoryang author, implementor o proponent si Aquino sa pagbubuo ng DAP.

Magkaklase sa Ateneo de Manila University si Aquino at Caguioa ngunit tiniyak ng Justice secretary na wala siyang kinikilingan.

Nauna nang sinabi nina SC Associate Justices Antonio Carpio at Marvic Leonen na kailangang mapanagot sa batas nina Aquino at Budget Secretary Florencio Abad dahil sa pagpapatupad ng DAP, ngunit kung mapatunayang in good faith ay maaaring hindi.
