Truth Commission kukuwestyunin sa Supreme Court

MANILA, Philippines - Nagbanta kahapon si Sen. Miriam Defensor-Santiago na kukuwestiyunin nito sa Supreme Court ang legalidad ng Truth Commission na binuo ni Pangulong Noynoy Aquino.

Ayon kay Santiago, maituturing na isang pag­labag sa Konstitusyon ang Executive Order no. 1  dahil Kongreso lamang umano ang maaring lumikha sa isang komisyon.

“Let me say it candidly, Executive Order Number 1 is a usurpation of legislative function and we all in the legislative branch have a bound and duty to oppose that kind of usurpation. Even if I have to go to the Supreme Court, even with my poor physical health to fight for it,” sabi ni Santiago.

Naniniwala si Santiago na dapat ay hiniling na lamang ng Malacanang sa Kongreso na magpasa ng isang panukalang batas na sinertipikahang urgent upang mabuo ang Truth Commission.

Nilabag umano ng Pangulo ang tinatawag na doktrina ng “non-delegation” kung saan hindi dapat nito sinasaklaw ang kapangyarihang hindi naman ibinigay sa kaniya ng Konstitusyon.

Samantala, sinabi naman ni Presidential Spokesman Edwin Lacierda na dapat bigyan muna ng pagkakataon ng mga kritiko ang Truth Commission na pamumunuan ni dating Chief Justice Hilario Davide.

Handa naman ang Palasyo na sagutin kung sakaling kukuwestyunin ang Truth Commission sa Korte Suprema.
