Impeachment court ‘di maaring maghatol ‘pag may TRO

MANILA, Philippines — Hindi maaaring magbaba ng hatol ang Senate impeachment court laban kay Vice President Sara Duterte kung maglalabas ng Temporary Restraining Order (TRO) ang Korte Suprema, kabilang na ang pagkuwestiyon sa voting threshold ng mga senator-judges.

Ito ang naging assessment ni House impeachment trial spokesperson at Lanao del Sur Rep. Zia Alonto Adiong kaugnay ng mainit na debate hinggil sa itinatadhana ng Konstitusyon na two-thirds vote o 16 mula sa kabuuang 24 senador para sa conviction.

“So my understanding would be, unless and until the Supreme Court issues TRO, then the Se­nate can— could proceed with the voting,” ani Adiong.

Batay sa Article XI, Section 3 ng 1987 Konstitusyon, walang sinumang opisyal ang maaaring ma-convict sa impeachment trial nang walang two-thirds vote mula sa lahat ng mi­yembro ng Senado.

Lumutang ang debate matapos na maraming senator-judges ang hindi nakakapagpartisipa sa proseso, dahilan upang igiit ni Sen. Miguel ‘Migz’ Zubiri na dapat nang pag-usapan ang voting ­threshold para sa pagbaba ng hatol.
