Power grab
“AN elective official, elected by popular vote, is directly responsible to the community that elected him. The official has a definite term of office fixed by law which is relatively of short duration. Suspension and removal from office definitely affects and shortens this term of office. When an elective official is suspended or removed, the people are deprived of the services of the man they had elected. Implicit in the right of suffrage is that the people are entitled to the services of the elective official of their choice. Suspension and removal are thus imposed only after the elective official is accorded his rights and the evidence against him strongly dictates their imposition.” Ganito ang malinaw na paalala ng Mataas na Hukuman, sa panunulat ng ponente na noo’y Associate Justice Reynato Puno, tuwing ang suspensyon ng isang halal na lokal na opisyal ang tinatalakay ng pamahalaan. Ang kaso noon ay ang administrative suspension ni Nueva Ecija Governor Edno Joson na umakyat sa Supreme Court sa case title Joson vs. Executive Sec. Ruben Torres.
Sa mga katulad nating nagmamasid kung ang aksyon ng ehekutibo ay naaayon sa itinatalaga ng batas, medyo nakababahala ang ikinilos nito laban kay Cebu Governor Gwendolyn Garcia na kilalang kaibigan ni Gloria Arroyo, haligi ng oposisyon at miyembro ng UNA. Suspendido ni Exec. Sec. Paquito Ochoa noong Dec. 18, 2012 si Garcia ng anim na buwan batay sa isang reklamong isinampa sa Office of the President noong 2010 pa.
Ang isyu ay ang hindi raw tamang pagsunod sa budgeting procedure. Walang paratang na corruption o anumang “offense involving moral turpitude”, mga salang karaniwang pinapatawan ng 6 months suspension. At dahil 2010 ba ito naisampa, malinaw na lumampas na ito sa takdang 120 day period ng batas upang magsagawa at matapos ang isang imbestigasyong administratibo.
Parang may bago nang patakaran ngayon, inamyendahan ng Palasyo ang isang mismong batas, na imbes na bilisan ang imbestigasyon laban sa halal na opisyal, maari na itong patagalin kahit mabitin at mabinbin ang pobreng akusado.
Ang vice governor na makikinabang sa suspensyon ni Garcia ay si Agnes Almendras Magpale ng Liberal Party, kapatid ni Cabinet Sec. Rene Almendras.
