Nakatanggap ng kopya ang "CALVENTO FILES" ng kanilang reklamo at aking ipapablish ang ilang puntong nakasaad sa kahilingan na matanggal sa pagka-abogado itong si Victor I. Padilla.
COMPLAINT-AFFIDAVIT
COMPLAINANTS, father Rogelio, widower and son Jose Malana, married, both of legal ages, Filipinos, residents and small farmers in Barangay Maguirig, Solana, Cagayan, under oath, depose and say that:
1. Sometime since 1960, complainant father Rogelio Malana, with some 20 other farmers have been tilling and cultivating small patches of land in the remote Barangay Maguirig, Cagayan, in peace;
2. Our woes started and peace was broken sometime in 1998, when the respondent Atty Victor I. Padilla, husband of RTC-Quezon City Judge Maria Luisa Quijano-Padilla, who resides at No. 445 San Jose II Street, Sampaloc, Manila where he may be served with out complaint, entered our farming areas, together with his armed men, and demanded that we vacate the premises which we have been tilling in peace for many years;
3. Atty Victor I. Padilla claims ownership of the whole Barangay Maguirig by virtue of an alleged deed of sale with the Lasam family although he can not produce any such document of sale. Atty. Padilla even went to change the arch gateway of the DENR to "NERINA PADILLA FARM" (his mother’s name) photos Annexes "A" and "A-1";
4. Despite the fact that Atty. Victor I. Padilla being a lawyer, knowing too well that he has no legal right at all over the land we have been cultivating for decades, far from acting justly as an honorable lawyer should, continuously harassed us with the aid of his armed men, many times, destroyed our farms, burned our crops and took them by force;
5. Sometime in May, 2000, Atty. Padilla wanted me, Rogelio, the father, to sign a document, the contents of which I do not know, and when I refused, Atty. Padilla and his armed henchmen detained me in the DENR office which they have used as quarters and threatened to shoot me;
6. Sometime in October 2000, we, together with some other farmers of Barangay Maguirig were picked up and detained for months on the trump-up charges of Atty. Padilla, however, the Provincial Prosecutor of Cagayan, dismissed the cases against us and in the resolution, exposed Atty. Padilla’s pretensions of ownership over Barangay Maguirig;
7. Unable to bear Atty. Victor I. Padilla’s abuses and his men, we filed charges against them before the Department of Justices for Illegal Detention, Incriminating Innocent Persons, and Perjury (Affidavit-complaints of Rogelio Malana as Annex "C" and of Jose Malana, Annex "D"), the action taken by the Provincial Prosecutor of Cagayan dated Novermber 26, 2001 (Annex "E");
8. We also filed, together with other farmers our complaints for Grave Threats, Grave Coercion, Arson, Robbery, Malicious Mischief (copies of our affidavit-complaints are hereto attached and made part hereof as Annexes "F" and "G", the actions taken thereon by the DOJ as Annexes "H", "H-1";
9. By good fortune, our feeble voices have been heard. No less than the House of Representatives took cognizance of our cause through House Resolution No. 727 (Annex "I"). The "Kilusang Magbubukid ng Pilipinas" (KMP) expressed support with its communication dated April 21, 2005 (Annex "J") and the press as well (Annexes "K" to "K-46");
10. Callous and in retaliation, Atty. Padilla filed against me (Jose Malana) on April 14, 2005 a case for libel in Tuguegarao, Cagayan and on April 17, 2005, Atty. Padilla with his influence, called a meeting through the Barangay Chairman, with some people of Bombo Radio, accompanied as usual by his armed men, threatened the farmers not to support the cases filed against him otherwise he would have them imprisoned as he did to herein complainants. Atty. Padilla also circulated his pre-made statement that if he wins the cases filed against him, he would award parcels of land to those who would side with him. Some were cowed, others succumbed to the promises of Atty. Padilla;
The enumerated abuses committed by Atty. Victor I. Padilla using his knowledge of law as a lawyer against the complainants who are only small impoverished farmers and bereft of education, are in utter violations of his oath as lawyer to do justice. Such unlawful abuses of a lawyer desecrate the profession and like cancer, the kinds of lawyer that Atty. Victor I. Padilla is, should be incised from Roll of Attorneys, if the dignity and honor of the profession should be maintained.
OUR PRAYER, with due respect is that this Honorable Body investigate and take steps to DISBAR the said Atty. Victor I. Padilla.

Pinarating din sa aking tanggapan na ang mga magsasaka ay sinampahan ng kasong ARSON ng taong inuugnay nila kay Atty Victor I. Padilla at ngayon ay pilit namang iniuugnay itong si Rogelio Malana sa isang Warrant of Arrest sa kasong MURDER na naganap sa Camarines Sur nung 1995 pa. Mariing itinatanggi niya ito at kapangalan lang daw niya itong nakasulat sa warrant na ROGER MALANA y DOE.
Ni wala ngang middle name, Camarines Sur naganap nung 1995 pa. Ngayon lang binubuhay. Tututukan natin ito at handa ang mga abogado ng Department of Justice na sampahan ng kasong Illegal Arrest kung sakali ngang basta na lamang damputin ang matandang Rogelio Malana, ayon kay Sec. Raul Gonzalez.
NAIS NAMIN SABIHIN na dahil sa kahilingan ng mga taong nais mapanood ang episode ng "ISUMBONG MO KAY TULFO" tungkol sa reklamong pang-aapi, forest grabbing nitong si Atty Victor I. Padilla na naipalabas sa channel 9, maaring makipag-ugnayan lamang sa aking mga telephone numbers o sa tanggapan ni Ramon Tulfo sa 633-9130 at hanapin si Mrs. Alin "Manang" Garganera-Ferrer.
