David opposes consolidation of SET, Comelec cases vs Poe

MANILA, Philippines - Losing senatorial bet Rizalito David on Wednesday filed a manifestation opposing the request of Sen. Grace Poe to consolidate the two cases filed against her before the Supreme Court (SC).

David earlier filed a petition before the high court to reverse the decision of the Senate Electoral Tribunal to affirm the natural-born citizenship of Poe.

On the other hand, Poe asked the SC to reverse the decision of the Commission on Elections (Comelec) en banc to disqualify her from the presidential race due to residency and citizenship issues.

David said in a five-page manifestation that the circumstance and cause of action in the petitions against the SET and Comelec decision are different issues.

The petitioner stressed that the cases originated from two different electoral tribunals.

Poe will be unseated as a senator if the high court reverses the SET decision.

The senator's name will not be included in the printing of ballot and she will be disqualified from the presidential race if the Comelec decision is upheld.
