SC partially grants Junjun's petition vs suspension case
MANILA, Philippines - The Supreme Court (SC) on Wednesday partially granted that petition of suspended Makati Mayor Jejomar Erwin "Junjun" Binay Jr. in connection to his preventive suspension over the alleged anomalous construction of the Makati City Hall Building 2.
During a press briefing, SC Spokesperson Theodore Te said the Court of Appeals (CA) was correct in applying the condonation doctrine in stopping the Ombudsman's suspension order against Binay.
Te clarified that the high court has abandoned the doctrine, but it is prospective in effect, making Binay the last to benefit from the common defense by elected officials in evading liabilities for acts committed in their previous terms in office.
The SC ordered the CA to proceed with the resolution of Binay's petition against the earlier suspension order issued by the Office of the Ombudsman.
The high court also decided that the petition of Binay before the CA should be dismissed on ground of mootness as it has no more purpose.
Last October 9, the Office of the Ombudsman ordered the dismissal of Binay from service and ordered his perpetual disqualification from public office due to the administrative case filed against him.
