CEBU, Philippines - “Relentlessly pursuing his quest for justice” on the deaths of his son and nephew, a father re-filed a case against a British National and an accomplice allegedly responsible for the killing.
Allan Borja filed anew a murder complaint against Frank Richard Bell and an unidentified man who allegedly killed his son Marlou Allan Borja, 19, and nephew Holden Harold Mancia, 16, in Cansomory, Balamban town January last year.
Borja, a resident of Dumlog, Talisay City, filed his affidavit-complaint before Provincial Prosecutor Pepita Jane Petralba.
May 31 last year, the Provincial Prosecutor’s Office dismissed the previous complaint Borja filed for insufficiency of evidence.
“The refiling is with new and material evidence in addition to the evidence submitted in the previous complaint,” Borja, 51, said in the new complaint.
Supporting the complaint is a joint affidavit of witnesses Maximo Atamosa, Jr., his wife Dionesia Atamosa, and son Andre executed on August 31, 2011.
Borja said he continues look for other witnesses from Barangay Cansomoroy and the neighboring barangay Poblacion.
It was in December last year, before Christmas, when Atamosa and his daughter went to his house in Dumlog, Toledo City. The elder Atamosa said he witnessed the incident.
In their affidavit, the Atamosa family said they were on their way home at 4 pm on January 31, 2010 when they saw a silver van with two men on the front seat.
They also saw a white man whom they believed to be an American stooping beside a man who was sprawled on the ground. They then saw the white man striking the man on the ground several times with a metallic object.
They alleged that the victims’ motorcycle was hit by Bell’s van, which was traveling behind.
They alleged further that suspects also planted evidence to make it appear that the victims fired a gun.
“However, in the process, making himself (Bell) positive on both hands for gun powder nitrates. These testimonies of the witnesses show the unmistakable facts and circumstances to point out to Bell as the culprit who killed my son and his cousin,” Borja said.
Borja said his son had just graduated high school from a school at the United States of America. At the time of his death, he was studying Nursing at the University of the Visayas. Mancia, on the other hand, was about to graduate high school.
“These boys could not be assassins. They were just boys who had a bright future to look forward to,” Borja said.
If there was any blunder his son has committed, it was for being entangled in an “amorous relationship with an experienced older woman, the wife of Bell, Juriza Mahinay Bell,” Borja disclosed.
Borja said Bell has reason to kill his son because oh the latter’s illicit relationship with his Filipina wife. — (FREEMAN)
