Fiscal recommends filing of charges vs. 'holduppers'
CEBU, Philippines – The Office of the Cebu City Prosecutor has recommended the filing of robbery with frustrated homicide charges against two men who allegedly robbed a woman in barangay Tabunok, Talisay City.
Associate Prosecution Hyacinth Jadraque has recommended a bail of P150,000 for Johnly Abangan and Jeffrey Paran who are being accused of fleeing with Myla Bariquit's blue belt bag containing P22,000, credits cards, and other identification cards.
Arresting officer PO1 Jessieben Gumandal, in his affidavit of arrest, stated that on November 10, 2010 at 10:45 in the evening, he saw Paran on a sky blue motorcycle punching a woman who was inside a multi-cab.
Gumandal said he also saw Abangan getting off the multicab carrying a .38 caliber revolver and a belt bag and then hearing someone shouting "holduppers."
The policeman said he immediately told the two men to surrender peacefully but instead Abangan aimed his gun at him.
But he beat Abangan to the draw, hitting him on the stomach, Gumandal said.
Abangan fell to the ground and was later taken to hospital.
Paran however fled, heading towards the town of Minglanilla.
He was arrested in barangay Poblacion in Naga, Cebu after a chase.
Abangan is also being charged with violating the Comelec gun ban.
The gun with five rounds was seized from Abangan shortly after getting shot. (FREEMAN)
