Move to require list of contractors legal
CEBU, Philippines - The City Council committee on laws believes that the proposed ordinance, which would require establishments undergoing construction to submit a list of contractors and subcontractors prior to the renewal of a business permit, is legal and valid.
However, the committee recommended that a public hearing be held, considering that the aim of the proposed ordinance is to mandate establishments to provide a list of their contractors and subcontractors to the City Treasurers Office.
The proposed ordinance authored by Councilor Nestor Archival aims to require “all horizontal and vertical developers and general contractors, proprietors and owners of malls and commercial establishments and tenants securing or renewing business license, building permits and or Mayor’s permit, to submit to the CTO their list of contractors and subcontractors for construction projects undertaken within the City of Cebu and providing penalties thereof.”
Labella said it is within the power of the City Council to enact ordinances granting permits and licenses, including terms and conditions, for the general welfare of the inhabitants of the City.
Archival said CTO admitted there are several contractors and subcontractors from Cebu City and those from other places but are doing business within the City who are not paying rightful fees to the City.
A public hearing is scheduled next week to be participated by all concerned parties.
If the proposed ordinance approved, it would reportedly make it easier for the city treasurer’s office to keep track of contractors and subcontractors operating legally within the city.
The proposed ordinance is also aimed to make it easier for the city government to track down contractors and subcontractors should there be violations committed in the conduct of their operations like what happened in Casa Rosita, barangay Tisa when a 10-meter fence collapsed into a house beside the structure, which killed a 49-year-old woman to death. — Ferliza C.
