A soldier was arrested after shooting a 23-year-old man who chased him for allegedly threatening his brother with a gun in sitio Brotherhood, barangay Basak-San Nicolas, yesterday dawn.

Mobile Patrol Group policemen arrested Technical Sergeant Rogelio Escotor Altubar, 44, a member of the Philippine Army assigned to the Civil Relations Service of the Central Command based in Camp Lapu-Lapu.

Altubar allegedly shot Vonray Ceniza, of sitio Kalubihan of the same barangay after Ceniza and other youths chased him.

Homicide investigator PO3 Rogelio Nedamo of the Homicide Section told The Freeman that Altubar was accused of threatening Ceniza’s brother, Noel, 22, with his gun for no apparent reason.

Police said based on the allegations of the people in the area Altubar was seen drinking in a videoke bar and after he saw Noel walking in the street he then approached him and pointed a gun at him.

People immediately informed Noel’s mother who then called their barangay tanod neighbor for help.

Noel and other neighbors then went back to the area and chased Altubar who was already waiting for a ride back to Camp Lapu-Lapu, the soldier saw the people coming and fired at them hitting Vonray in the right shoulder in the process.

The victim’s relatives immediately brought him to the Cebu City Medical Center.

PO1s Clifford Mantura and Sir Abatayo of the Mobile Patrol Group responded to the alarm and arrested Altubar, recovering from him his Colt .45 cal. pistol, a black inside holster and three magazines.

He also had a Firearm and Other Deadly Weapons Ban Exemption document issued last February 28, 2007.

Altubar, when interviewed by The Freeman after undergoing a paraffin test at the PNP Crime Laboratory yesterday, said he did not threaten Noel but merely asked him why he was bringing a baton, but Noel reportedly got angry and this led to an argument.

He added that he was surprised when he was chased by several men while he was waiting for a ride and fired warning shots at them.

A case of frustrated homicide will be filed by the Homicide Section against the soldier before the City Prosecutor’s Office. — Edwin Ian Melecio/BRP
