Controversial cop faces summary dismissal

An investigating team from the National Police Commission (Napolcom) has recommended summary dismissal proceedings against controversial policeman Adonis dumpit.

This as the Napolcom indicted SPO1 Dumpit for an administrative case on the alleged murder of a robbery suspect almost two years ago.

Napolcom regional director Estrella Avena approved the recommendation of the investigating officer earlier tasked to look into the allegation that Dumpit murdered robbery suspect Ron-Ron Allosada Go in Sitio Sampaguita Villagonzalo II in barangay Tejero.

Lawyer Zandro Ronnie Oriol, who investigated the complaint filed by Go's mother, Janneth Allosada, recommended that summary dismissal proceedings should be conducted against Dumpit on the charge of grave misconduct.

"After careful and judicious evaluation of the evidence submitted by both parties, the Napolcom investigating officer finds probable cause to administratively charge the herein respondent for the offense above-cited," Oriol said in his recommendation.

Such was adopted by the acting chief of the summary dismissal authority of the commission.

Oriol said that Dumpit never denied that he shot Go although he justified his action as an act of self-defense and the fulfillment of his duty as a police officer as provided for under Article 11, Section 1 and 5 of the Revised Penal Code.

"With the admission of Dumpit to the killing of Ron-ron Go, the burden of proof now lies with the herein respondent to prove that the killing was under justifiable circumstances provided under the law," the Napolcom resolution said.

It added that to "ferret out the truth a formal hearing is imperative."

The Napolcom has ordered Allosada to appear before the office on December 8 to sign a formal complaint against Dumpit.

The case stemmed from an investigation report of the National Bureau of Investigation (NBI) wherein Dumpit was tagged by the victim's mother as the one who killed her son in the afternoon of December 14, 2004.

Janeth said that shortly before her son was shot to death, Dumpit together with PO3 Ruel Hortela and PO3 Porferio Gabuya arrived in the company of three alleged robbery victims, looking for Ron-ron.

According to Janeth, she told Dumpit that she was not aware of her son's whereabouts during that time.

Dumpit and company left, but five minutes later she heard two gunshots. A minute later, a neighbor told her that her son was shot. Three witnesses, Jimmy Villaluz, Andres Satorre and Raymund Badiana, identified Dumpit as the alleged perpetrator.

Dumpit admitted having shot the victim, but claimed he did it to defend himself. According to Dumpit, he was inside his house then because he was off-duty when he heard someone calling out his name from outside.

A woman asked for his help because her 14-year old daughter was allegedly victimized by armed robbers and the description of one of the suspects fit Go.

Dumpit said, he immediately went to see Go's mother to verify his whereabouts. He added that when they found out that Go was not in their house he immediately went home. However, on his way home he met a certain Jimmy Mendiola, who told him that armed robbers are going to the direction of the residence of a certain Pepe Regis.

As a policeman, Dumpit said he responded and found out that one of the members of the group was Go.

A certain Jun-Jun Bador, Go's companion, allegedly fired at him but he was able to drop to avoid being hit. While on cover, he allegedly heard another shot coming from Go's group and saw the latter running with a gun pointing at his direction prompting him to fire his gun, supposedly to disable Go.

In fact, Dumpit said he immediately brought Go to the hospital when the latter fell to the ground after he was hit. Unfortunately Go died at the Cebu City Medical Center while his other companion was arrested by the members of the Special Weapons and Tactics.

Dumpit's witnesses - Kimberly Corro, Elizabeth Corro, Jimmy Mendiola and Francis de los Santos corroborated his claim that the incident was a legitimate encounter.
