City prosecutor Nicolas Sellon has approved the filing of homicide charges against Hormecillo and recommended a P40,000 bail for his temporary liberty once he will be arrested. The city prosecutors office had sent a subpoena to Hormecillo for him to answer the charges but the latter reportedly just ignored it, which prompted assistant prosecutor Aida Sanchez to resolve the case based on the evidence on file.
Sanchez said nobody saw the accused stab the victim, but a certain Alex Rafols had executed an affidavit that Hormecillo confessed to him of the crime immediately after he did it. Rafols, a 40-year-old friend of Hormecillo, said he observed that the latter was drunk at about 9:30 p.m. of September 11 - or half an hour after Mata was stabbed.
An existing ordinance requires barbecue vendors to cut the pointed ends of bamboo sticks they are using before selling their products to the public.
The ordinance explained that if the pointed ends of these barbecue sticks or bamboo skewers are not cut, these could be converted into deadly weapon that could be used to perpetrate a criminal act. However, until now almost all of the barbecue vendors have ignored the ordinance. - Rene U. Borromeo
