MANILA, Philippines — Iisa ang posisyon ng apat na Filipino legal experts hinggil sa utos ng International Criminal Court’s (ICC) na arestuhin si dating Pangulong Rodrigo Duterte dahil sa kinakaharap nitong kasong may kaugnayan sa crimes against humanity.

Ayon sa apat na kilalang mga legal experts na sina dating Supreme Court Associate Justice Antonio Carpio, ICT Senior Associate Ruben Caranza, dating ICC Judge Raul Pangala­ngan, at rights lawyer Ted Te, “legal” at “warranted” ang pag-aresto sa dating pangulo.

Anila, ang gobyerno ng Pilipinas ay sumunod lamang sa proseso sa ilalim ng Republic Act No. 9851, o ang “Philippine Act on Crimes Against International Humanita­rian Law, Genocide, and Other Crimes Against Humanity.”

Ang pagdakip ani­la kay Duterte ay salig sa Article 17 ng Rome Statute, kung saan ang Pilipinas ay pinapayagan na direktang isuko ang isang indibdwal sa ICC dahil sa pagkakasangkot sa international crimes.

Nagtataka rin ang mga legal expert sa pagpupumilit ng mga kaalyado at tagasuporta ng dating­ pangulo na ilegal ang pagkakaaresto dito at pagdadala sa kaniya sa The Hague.
