Costa del Hamilo refutes land claim
MANILA, Philippines - A Notice to the Public came out again in the STAR Oct. 9 from Maria de Joya Dikit, et al. repeating their claims made in an ad printed a week ago, Oct. 2 that they have claims over certain portions of Pico de Loro Beach and Country Club based on the Emancipation Patents (EPs) allegedly awarded to them covering the said property.
In the Oct. 9 ad Ms. Dikit replied to Costa del Hamilo Inc.’s (CDHI) rejoinder which appeared in the Oct. 3 issue of STAR.
By way of comment to the said reply of Ms. Dikit, CDHI states:
1. DAR did not err in naming Manila Southcoast Development Corporation (MSDC) as the registered owners and proper applicant over the property being claimed by Ms. Dikit et al and one of the lots covered by Conversion Order No. 040117025-(199)-98, MSDC being able to submit proof of ownership over the said property to DAR. As registered owner of the subject property, MSDC need not acquire the same from Ms. Dikit,et al.
2. The August 29, 2014 Order in DARAB Case No. R-0401-0006-2014 has already been reversed and set aside by a subsequent Order dated November 7, 2014 which dismissed the petition filed by Ms. Dikit to have their EPs transmitted to the Registry of Deeds of Nasugbu, Batangas for registration.
3. Ms. Dikit et al. confirmed the existence of the above mentioned November 7, 2014 Order which dismissed their petition before the DARAB to have their EPs transmitted to the Registry of Deeds of Nasugbu, Batangas for registration.
