PANOORIN: VP Sara, hindi obligadong sumagot sa request for admission
MANILA, Philippines — Nagpasya ang Senate impeachment court na hindi kailangang sagutin ni Vice President Sara Duterte ang request for admission ng prosekusyon, batay sa kanyang karapatan laban sa self-incrimination.
"Respondent need not answer the request for admission and her failure to answer shall not be deemed an admission," ayon kay presiding officer Chiz Escudero ngayong Martes, Setyembre 29.
Inihain ng prosekusyon ang request noong Setyembre 8, kung saan hiniling nito kay Duterte na pormal na aminin o tanggihan ang nasa 104 na usapin kaugnay ng business interests at mga bank at tax records ng kanyang asawang si Manases Carpio.
Tumutol ang depensa sa request noong Setyembre 23, at sinabing hindi maaaring ilapat sa impeachment ang rule sa mga requests for admission.
"The prosecution cannot shift its burden of proof to respondent through the simple expedience of a request for admission," ani Escudero.
Samantala, itinanggi ng impeachment court ang kahilingan ng depensa na burahin sa rekord ang naturang request.
"The request for admission shall have no evidentiary, factual or prejudicial effect against the respondent," dagdag ni Escudero.
