'Early birthday gift?': SC ibinasura 30-year-old coco levy graft charges vs Enrile
MANILA, Philippines — Tuluyang ibinasura ng Korte Suprema ang kasong "graft" laban kina chief presidential legal counsel Juan Ponce Enrile — na magiging 99-anyos sa Valentine's Day — kaugnay ng diumano'y pagbulsa sa P840.7 milyong coco levy funds noong panahon ni dating Pangulong Ferdinand Marcos Sr.
Ito ang sinaad sa 53-pahinang desisyon ni Associate Justice Ramon Paul Hernando na isinapubliko, Miyerkules, kung saan inuuutusan ng Supreme Court ang Office of the Ombudsman na i-dismiss ang reklamong inihain laban kina Enrile, negosyanteng si Jose Concepcion, Rolando dela Cuesta, Narciso Pineda at Danila Ursua.
Iniutos din nito ang pagbasura graft case na inihain laban kay Eduardo Cojuangco Jr., Jose Eleazar Jr., Maria Clara Lobregat at Augusto Orosa "dahil sa kanilang supervening deaths."
Sa kabila nito, sinabi ng korte na pwedeng maghain ng hiwalay na civil charges laban sa mga ito para sa "civil liability based on sources other than delict... as may be warranted by law and procedural rules."
"If already filed, the said separate civil action shall survive notwithstanding the dismissal of the criminal case in view of their deaths," dagdag pa ng Kataas-Taasang Hukuman.
Kanila ring idiniin na isantabi na at ibaliktad ang review at rekomendasyon noong Agosto 1998 pati na ang utos ng Office of the Ombudsman noong Setyembre ng taong 'yun.
"With this case pending for over 30 years and possibly more without the assurance of its resolution, the court recognizes that the tactical disadvantages carried by the passage of time should be weighed against petitioner (government) and in favor of the respondents (Enrile and others)," saad ng korte.
"Certainly, if this case were remanded for further proceedings, the already long delay would drag on. Memories fade, documents and other exhibits can be lost and vulnerability of those who are tasked to decide increases with the passing of years. In effect, there would be a general inability to mount an effective defense."
Ang kasong inihain sa dating senador na si Enrile ay umusbong mula sa mga alegasyon ng Presidential Commission on Good Government, na siyang humahabol sa mga nakaw na yaman ng diktaduryang Marcos, na sinamantala ni Cojuanco Jr. ang kanyang pakikipagkaibigan sa dating presidente para sa kanyang pansariling kapakanan sa pamamagitan ng mga decrees na inilabas pabor sa kanya.
Pumasok kasi noon sa kasunduan ang gobyerno at si Cojuangco Jr. sa pamamagitan ng state-run National Investment and Development Corp. (NIDC) para ipatupad ang ang Presidential Decree 582 na siyang bumuo sa Coconut Industry Development Fund.
Matapos noon, nagpalago si Cojuangco Jr. ng mga niyugan sa Bugsuk Island, Palawan sa pamamagitan ng Agricultural Investors Inc. na siyang nakinabang daw mula sa programa sa pamamagitan ng NIDC.
Sinasabing lugi ang gobyerno sa mga terms and conditions sa pagitan ng NIDC at AII na siyang kinasasangkutan daw ng mga akusado gaya na lang nina Enrile at Cojuangco. Pareho silang bahagi ng United Coconut Planters Bank board of directors.
