Badoy sinampaha ng ‘indirect contempt’

MANILA, Philippines — Nagkakaisang sinampahan ng mga abogado at mga law school dean ng kasong ‘indirect contempt’ sa Supreme Court si dating National Task Force to End Local Communist Armed Conflict (NTF-ELCAC) spokesperson Loorain Badoy dahil sa mga social media posts nito laban kay Manila Judge Marlo Magdoza-Malagar.

Pinangunahan ni Philippine Bar Association president Rico Domingo ang mga abogado sa paghahain ng Urgent Petition for Indirect Contempt laban kay Badoy kahapon.

Base umano ito sa ilang posts ukol sa desisyon ni Judge Magdoza-Malagar, na kamakailan ay dinismis ang petisyon ng pamahalaan ng Pilipinas na ideklarang terorista ang CPP-NPA.

Kasama ni Domingo sina law school deans Tony La Viña, Ma. Soledad Deriquito-Mawis, Anna Maria Abad, Rodel Taton; at mga abogadong sina Artemio Calumpong, Christianne Grace Salonga, Ray Paolo Santiago at Ayn Ruth Tolentino-Azarcon.

“We believe that considering the gravity and nature of statements of former [Unersecretary] Badoy, we believe that it would be punishable of indirect contempt, Rule 71 Section 3D,” saad ni Domingo.

Ang contempt of court umano ay lumalarawan sa: “any improper conduct tending, directly or indirectly, to impede, obstruct or degrade the administration of justice.”

Nakasaad sa petisyon na ang mga Facebook posts ni Badoy ay tahasang sumisira sa reputasyon at kredibilidad ni Judge Malagar at tinatanggal ang respeto hindi lamang para sa huwes ngunit maging umano sa lahat ng miyembro ng Philippine Bench at Bar.
