Nuisance candidate pagmultahin – Gatchalian

MANILA, Philippines - Nais ni Valenzuela City Rep. Win Gatchalian na pagmultahin ng P50,000 ng Commission on Elections (Comelec) ang sinumang mapapatunayang nuisance candidate na tumatakbo sa elective positions.

Naghain ng House Bill 6252 si Rep. Gatchalian ng Nationalist Peoples Coalition (NPC) upang magkaroon ng mas malawak na legal ground ang Comelec sa pag-classify sa mga indibidwal bilang nuisance candidates at nag-aamyenda sa Omnibus Election Code.

Sa ilalim ng HB 6252, ang Comelec ang magdedetermina kung sino-sino ang nuisance candidates at ituturing itong election offense na mayroong karampatang multa.

Aniya, bagamat nakasaad sa 1987 Constitution ang pagtiyak ng equal access sa oportunidad para sa public service ay dapat madetermina din kung ang tumatakbo ay mayroong karampatang kakayahan sa tinatakbong puwesto o isang nuisance candidate lamang.

“However, in a resolution of the Supreme Court, it clarified the view that running for public office is a privilege, not a right. It is subject to the limitations imposed by law and must take into account practical considerations,” dagdag pa ni Gatcha­lian na tumatakbong senador ng NPC sa 2016 elections.

Wika pa nito, may mandato ang Comelec na tanggapin ang certificate of candidacies ng mga tumatakbo sa ibat ibang elective positions pero sinasala pa din ito ng poll body kung talagang may kakayahan itong mangampanya sa tinatakbong puwesto.
