Preliminary injunction vs DOH rule

MANILA, Philippines - Isang preliminary injunction order ang ipinalabas kamakailan ng Manila Regional Trial Court na pansa­man­talang pumpigil sa pagpapatupad ng Department of Health Administrative Order (AO) 2010-0008 sa isang bagong advertising guideline na nagtatakda ng bagong disclaimer para sa mandatory placement sa lahat ng promotional at advertising materials ng pagkain o dietary­ supplement products.

Sa halip na ang kasalukuyang disclaimer na “NO APPROVED THERAPEUTIC CLAIM”, iniutos ng AO ang pagla­lagay ng “MAHALAGANG PAALALA: ANG (NAME OF PRODUCT) AY HINDI GAMOT AT HINDI DAPAT GAMI­TING PANGGAMOT SA ANUMANG URI NG SAKIT”.

Sa isang six-page decision na nilagdaan ni Judge Lucia Purugganan, ipinag-utos din ng korte na pairalin ang  ‘status quo’ hanggang hindi pa nareresolba ang legalidad ng AO.

Nakasaad pa sa kautusan ng korte na, “The irreparable injury that plaintiff (CHIPI) is in danger of sustaining is the erosion of confidence that the public may have towards food/dietary supplements on account of the misconception or the misperception that the assailed AO will produce.”

Ipinaliwanag ng Chamber of Industries of the Philippines, Inc. (CHIPI) sa kanilang reklamo ang kawalan ng konsultasyon at due process sa pagpapalabas ng AO.
