Girl sues man she met at beach for rape
CEBU, Philippines- A 16-year-old girl has sued a 37-year-old man she met at a beach in Talisay City and who allegedly raped her at his house later.
The girl said she met the suspect on August 2, 2015 at Cansojong Beach where she, her siblings, and their neighbors were having a picnic.
While they were playing, the suspect, a resident of Barangay Basak San Nicolas, Cebu City, approached and befriended their group.
When they decided to go home, the suspect allegedly went with them because he reportedly wanted to see their house. Once there, the suspect reportedly convinced them to go with him to his house.
The complainant said she refused at first but her younger brother reportedly wanted to go so she eventually gave in.
They reportedly arrived at the suspect’s house at around 4:30 p.m. and the suspect reportedly asked her brother to buy a bottle of beer. After her brother left, the suspect began undressing her and abusing her sexually.
“I tried to resist with what the suspect is doing to me but I was so afraid,” the complainant’s affidavit reads.
The suspect reportedly gave her and her brother P30 for fare going home. She subsequently told her parents what happened and they went to the Mambaling Police Station to report the incident.
Police Officer 3 Anselmo delos Santos and PO2 Rusty Pelayo said they were the ones who arrested the suspect at his residence.
The suspect earlier manifested to answer the charges at the prosecutor’s level during preliminary investigation but he failed to present evidence in his defense during the time given.
“...despite the period given to respondent, no evidence has been submitted in his behalf. From the allegation in the complaint, the undersigned submit that there exists probable cause to charge respondent with violation of Article 266 A (2) of Republic Act 8353 otherwise known as The Anti-Rape Law of 1997,” the prosecutor’s resolution reads.
No bail was recommended for suspect. (FREEMAN)
