Old man indicted for lascivious acts

CEBU, Philippines - The Cebu City Prosecutor’s Office has indicted an old man for two counts of acts of lasciviousness.

Prosecutor Jill Ann Paculba-Gealon held a 68-year-old man for trial after finding probable cause in the complaint filed by a nine-year-old girl last year.

Gealon recommended P290,000 bail for accused’s temporary liberty.

  “Following a thorough evaluation of the record, there exists probable cause to charge respondent of the crime of acts of lasciviousness under Article 336 of the Revised Penal Code pursuant to paragraph 5 of Republic Act 7610 or child abuse,” the resolution read.

The victim alleged that on July 31, 2014 at about 5 p.m. while she was playing at the back of their house, the accused invited her to go inside his house. Once inside, she was made to sit on a sofa next to him.

The accused, whose name withheld by The Freeman to protect the identity of the victim, instructed her to sit on his lap and started abusing her.

The victim said she was given P20 after and warned not to tell anyone of what he did to her.

The incident was repeated on August 9, 2014. The victim was again invited inside the house of the accused where the alleged bestial act occurred. The victim was given P5 this time with loom bands and junk foods. She was again warned not to tell about the incident.

The accused was directed to answer the complaint but failed prompting the investigating prosecutor to resolve the complaint based on the evidence at hand.  (FREEMAN)
