Woman, 21, faces charges for posting nude photos of minor
CEBU, Philippines — The Prosecutor’s Office has indicted a 21-year-old woman for allegedly publishing and posting on a social networking site the nude photos of a 17-year-old girl.
The minor, a Grade 12 senior high school student of a university in Cebu City, filed a case for violation of Section 4(d) of Republic Act (RA) 9995 or Anti-photo and Video Voyeurism Act in relation to RA 10175 or Cybercrime Prevention Act.
The FREEMAN withheld the name of the accused to protect the identity of the minor since the two know each other.
In her complaint, the 17-year-old girl alleged that she took nude photos of her using her mobile phone and sent it to her boyfriend through messenger because he asked for it.
The pictures, she said, was meant to show or express how much she loves her boyfriend.
In January 2018, she lost her phone in her school.
Her boyfriend informed her that his aunt received nude photos of her.
The minor said she learned that it was the accused who allegedly caused the publication and posting of her photos.
When she confronted the accused, she was told that she received the photos from one of her classmates, a 17-year- old girl.
However, when she pleaded to delete it, the latter allegedly did not heed her request.
The minor was told by her classmates that one of her photos was posted on the Facebook wall of almost all of her classmates.
Prosecutor I Russell Busico issued a subpoena directing the respondents to submit their counter affidavits but they failed.
Upon evaluation, Busico found probable cause against the 21-year-old woman while he dismissed the complaint against a 17-year-old classmate for insufficiency of evidence.
He recommended P200,000 bail for the temporary liberty of the accused. — MBG (FREEMAN)
