The National Bureau of Investigation arrested two of the accused - PO2 Robert Cuyos and PO1 Leo Batigalao - after the complainants, Francisco and Dahlia Nabua, sought police assistance on June 21.

The Nabuas claimed that Batigalao had extorted close to P100,000 from them since May. They alleged that PO2 Cyril Valencia was also involved in the extortion.

Represented by Reynaldo Villordon Jr., NBI-7 said in a motion for reconsideration that there is "probable cause to indict Cuyos because he is a principal by indispensable cooperation considering that he was the driver of the motorcycle used in the commission of the crime."
