The Supreme Court directed the Commission on Elections to allow Legazpi City Mayor Noel Rosal to continue performing as mayor while the true results of the 2004 mayoral race are being determined. 


The Supreme Court maintained the status quo and instructed the Comelec to determine the duly elected mayor "with utmost dispatch" and respect for Rosal’s right to be heard.

In an en banc decision, the Comelec affirmed the resolution of its second division with modification on the number of votes obtained by the contending parties.

The poll body ruled that Imperial won the elections with a margin of 2,188 votes by getting 33,861 votes against Rosal’s 31,673.
