In a letter sent to the President last Tuesday, 39 justices of the appellate court said their colleague, Presiding Justice Cancio Garcia, deserves to fill the post vacated by SC Justice Josue Bellosillo last November.


The appellate court justices noted that Garcia had been bypassed five times by other junior appellate justices.

Justices of the Court of Appeals yesterday called on President Arroyo to consider appointing somebody from their ranks to the Supreme Court.


In a manifesto, the CA justices lamented that only one of the five nominees to fill SC vacancies came from the appellate court for the "first time in many years," when the CA should be the "traditional source of promotion" to the highest court of the land.

This possibility developed after the Supreme Court (SC) junked yesterday a petition by Jimenez to nullify the votes of four justices who refused to grant him bail while his extradition case to the US remains pending at the Manila Regional Trial Court.
