CA stops BID from deporting Graham

The Court of Appeals (CA) stopped the Bureau of Immigration (BID) from deporting Basketball Association of the Philippines (BAP) secretary-general Graham Lim who was found earlier to be a Chinese citizen.

In a two-page resolution penned by Associate Justice Rodrigo Cosico, the CA’s 7th Division granted Lim’s petition for preliminary injunction seeking to stop his deportation.

The CA ordered Lim to post a bond of P100,000 for his temporary liberty.

Last May 26, the temporary restraining order (TRO) issued by the CA against the BI lapsed.

The CA said the preliminary injunction is necessary to maintain the status quo between the parties pending the resolution of the case.

On March 29 last year, the BID ruled to deport Lim for "willfully misrepresenting" himself as a Filipino despite being a Chinese citizen.

Records gathered by the BID showed that Lim had previously been registered as a foreign national while his parents, namely How Ang Lim and Mary Lim Chua, were both Chinese citizens.

Justice Secretary Raul Gonzalez also ordered the arrest and immediate deportation of Lim for violating Philippine Immigration Laws.

In a ruling last April, the CA 7th division ordered the BID to release Lim from detention.

The CA said the BID should release Lim because the basis of his detention is the deportation order of the BID which the CA has already enjoined.
