Suspek sa pagpatay sa Japanese lumaya

MANILA, Philippines - Matapos ang dalawang taon na pagkakakulong, laya na ang isang lalaking pinatawan ng habambuhay na pagkakabilanggo dahil sa umano'y pagkakasangkot sa pagpasalang sa isang Japanese national at pagkasugat ng asawang Filipina sa Tayug, Pangasinan.

Iniutos ng Court of Appeals ang pagpapalaya kay Eleorie Arzadon Saldivar na nauna nang nakulong dahil sa kaso ng pagpaslang kay Koji Suzuki at pagkasugat ng asawang Filipina na si Lily Ylarde Suzuki.

Binaril at napatay si Suzuki habang sugatan naman si Lily sa insidenteng naganap bandang 3:00 ng hapon noong NOv. 10, 2009 sa Barangay Barangobong, Tayug.

Pinatawan ni Tayug Regional Trial Court Branch 51 Judge Ulysses Raciles Butuyan si Saldivar noong Mayo 30, 2012 ng habambuhay na pagkabilanggo dahil sa kasong murder, frustrated murder at theft. Pinatawan din ng kaparehong parusa ang hindi kilalang kasama ni Saldivar.

Ayon Court of Appeals, nabigo ang prosekusyon na patunayang may kinalaman si Saldivar sa pagpaslang kay Suzuki. Sinabi nitong walang sapat na ebidensyang magsasabi na kasabwat si Saldivar ng isa pang hindi kilalang suspek sa pagpaslang kay Suzuki.

"In fine, there is no evidence beyond reasonable doubt that the accused appellant independently committed the crime as charged. And no such evidence was established beyond reasonable doubt that the accused performed an overt act in the furtherance of a conspiracy," anang Court of Appeals.

Dagdag nito: "Finally, lest we be misunderstood, this Court is not saying that actually, accused appellant did not commit the crime. What it simply opines is that if at all, the prosecution failed to establish his guilt on all charges beyond reasonable doubt."
