SC ipinawalambisa 'amnesty revocation' ni Duterte vs Trillanes

MANILA, Philippines — Idineklarang "unconstitutional" ng Korte Suprema ang proklamasyon ni dating Pangulong Rodrigo Duterte na nagbabasura sa amnestiyang iginawad noon kay ex-Sen. Antonio Trillanes IV.

Matatandaang Agosto 2018 nang lagdaan ni Digong ang Proclamation 572 na siyang nagpapawalambisa sa amnestiyang iginawad kay Trillanes kaugnay ng 2003 Oakwood Mutiny at 2007 Manila Peninsula Hotel Siege.

"[T]he Supreme Court En Banc ruled that the amnesty granted to former senator Antonio F. Trillanes IV (Trillanes) is valid and that its revocation through Proclamation No. 572, issued by former President Rodrigo R. Duterte, is unconstitutional," ayon sa isang pahayag ng SC nitong Miyerkules.

"The Court, speaking through Associate Justice Maria Filomena D. Singh, ruled that a President cannot revoke a grant of amnesty without concurrence from Congress."

Tumutukoy ang amnestiya sa kapangyarihan ng presidenteng magpatawad o magpalampas sa mga reklamong kriminal — kadalasan para sa mga political offenses — ng isang grupo bago makapaglabas ng hatol. Alinsunod ito sa Section 19, Article VII ng 1987 Constitution.

Ibinase aniya ng Korte ang desisyon nito sa kahalagahan ng Bill of Rights at idiniing hindi nakatataas sa batas ang gobyerno't mga opisyal nito, kahit na ang presidente.

"The Court ruled that the revocation of Trillanes’ amnesty long after it became final and without prior notice violated his constitutional right to due process," dagdag pa ng SC.

"Further, Proclamation No. 572, in seeking the revival of the criminal cases against Trillanes after they had been dismissed with finality, violated his constitutional rights against ex post facto laws and double jeopardy."

Bakit ni-revoke ang amnestiya noon?

Una nang sinabi ng Proclamation 572 na "hindi naghain ng Official Amnesty Application Form si Trillanes" kahit nagawaran siya ng amnesty ng gobyerno sa pamamagitan ng Proclamation 75.

Humaharap noon sa paglilitis para reklamong coup d'état si Trillanes sa korte, maliban pa sa mutiny o sedisyon, conduct unbecoming an officer atbp. sa Military Tribunal.

Pinatototohanan daw ang kawalan nito ng  sertipikasyong inilabas ng isang Lt. Col. Thea Joan N. Andrade, heppe ng Discipline, Law and Order Division ng Office of the Deputy Chief of Staff for Personnel.

Iginigiit ni Trillanes, na kilalang kritiko ni Duterte, na totoong naghain siya ng application for amnesty noon. Gayunpaman, sinabi ng proklamasyon ni Duterte na hindi nagpakita ng anumang "guilt" si Trillanes para sa Oakwood Mutiny at Manila Peninsula Incident.

Nobyembre 2018 nang sabihin ng Department of Justice na ang kawalan ng guilt ni Trillanes ay "katumbas ng pagbawi ng amnesty application." Hinihingi raw kasi ng amnesty application para sa Proclamation 75 na magpahayag ng pagsisisi ang mga gumawa ng krimen.

"Finally, the Court found that there is convincing evidence that Trillanes did file his amnesty application," tugon ng SC.

"The Executive’s decision to revoke only Trillanes’ amnesty, notwithstanding the fact that the application forms of all the other amnesty grantees could similarly no longer be located, constituted a breach of his right to the equal protection of the laws."

Ang desisyon ng Korte ay pagkilala aniya sa pagbabalanse ng presential prerogatives at proteksyon ng karapatan ng mga mamamayan sa pamamagitan ng Saligang Batas.
