Ang Stradcom at LTO

Napag-Usapan namin ng aking anak na si Senate President Pro Tempore Jinggoy Ejercito Estrada ang kumakalat na liham umano ng Stradcom kay LTO Chief, Assistant Secretary Virginia Torres noong Marso 23, 2011. Narito ang bahagi ng liham:

“Dear Asst. Sec. Torres,

… the Land Transportation Office… has failed and refused, and continues to so fail and refuse to remit payment of the Fees due Stradcom Corporation for I.T. Based Services… Accordingly, this fact, a matter within the reasonable control of the DOTC/LTO or the Government of the Republic of the Philippines, constitutes a force majeure event now constrained to be invoked by Stradcom Corporation, par­ticularly with respect to its consequent effects on the operations and maintenance of the I.T. Facilities.

Otherwise stated, the now anticipated impairment in the normal nationwide operations of the I.T. Facilities… shall not or cannot give rise to a claim against Stradcom Corporation… In this regard, we will expect the DOTC/LTO to jointly explain this consequence to the transacting public…

Makabubuting pag-aralan ng mga kinauukulan ang sinabi sa liham na “anticipated impairment in the normal nationwide operations of the I.T. Facilities…” Dapat suriin ang sitwasyon kung saan ay kayang-kaya ng kompanya na i-hostage ang pamahalaan sa pamamagitan ng bantang pagkadiskaril sa serbisyo-publiko.
