Elenita wants graft raps junked
MANILA, Philippines — Elenita Binay, the wife of former vice president Jejomar Binay Sr., has asked the Sandiganbayan to allow her to seek the dismissal of her graft and malversation cases without presenting any counter-evidence.
In her motion for leave of court to file a demurrer to evidence recently submitted before the Sandiganbayan’s Third Division, Elenita claimed that the Office of the Ombudsman’s prosecution panel failed to prove her guilty beyond reasonable doubt.
A demurrer to evidence seeks the dismissal of a case halfway through the trial based solely on the evidence presented by the prosecution.
Elenita is facing two counts of graft and two counts of malversation of public funds before the Third Division.
Filed by the ombudsman in 2011, the cases stemmed from the alleged anomalous purchase of hospital beds and cabinets worth P36.43 million in 2001 and autoclave sterilizers worth P8.83 million in 2000 for the Ospital ng Makati during Elenita’s term as mayor.
