MANILA, Philippines — Globe Asiatique president Delfin Lee will have to remain in jail despite the Supreme Court (SC) decision that downgraded his case and allowed him to post bail, according to the Department of Justice (DOJ).

“He cannot be granted bail yet since the Supreme Court decision is not yet final and executory,” acting prosecutor general Richard Anthony Fadullon, head of the DOJ prosecutorial arm, told reporters yesterday.

Lee is detained at the Pampanga provincial jail.

On Tuesday, the DOJ asked the high court to reverse its ruling in July that affirmed a Court of Appeals decision in 2013 downgrading the charges filed against Lee from syndicated to simple estafa.

“We believe that it is a syndicated estafa case, which is a non-bailable case... He should not be allowed to post bail,” Fadullon said.

In a 47-page motion for reconsideration, the DOJ insisted that Lee, Globe Asiatique vice president Dexter Lee, accounting head Cristina Salagan, documentation head Christina Sagun and PagIBIG Fund foreclosure manager Alex Alvarez “clearly committed fraud.”
