P’sinan mayor cleared in another admin case

LINGAYEN, Philippines   â€“ For the second time in a month, the provincial board of Pangasinan dismissed another administrative case filed against Binmaley town Mayor Simplicio Rosario.

Board member Alfonso Bince Jr., chairman of the committee on good government and accountability of public officers, said the board junked the charges of grave abuse of authority and misconduct filed against Rosario.

The charges were filed by Marilyn Zamora, the town’s human resources officer, whose appointment was questioned by Rosario before the Civil Service Commission (CSC).

The case stemmed from the mayor’s designation of three personnel as officers-in-charge of the permit and licenses, general services and human resource management offices.

Zamora alleged the personnel occupied first-level positions but were designated to perform second-level functions, which she said was a violation of a CSC memorandum.

The committee rejected Zamora’s arguments, saying the personnel were qualified to the positions.

“There was no grave misconduct committed as no proof was submitted that there was a clear intent to violate the law,” the committee said.

Although the board dismissed the complaint for grave abuse of authority and grave misconduct in office, it reprimanded Rosario for committing simple misconduct in office.

The committee recommended to the mayor the establishment of a grievance procedure to inquire into, act upon, resolve or settle complaints and grievances of the municipal employees.
