ER seeks reversal of DQ case

MANILA, Philippines - Laguna Gov. Emilio Ramon “ER” Ejercito yesterday sought the reversal of a Commission on Elections (Comelec) decision disqualifying him for overspending in the May polls.

In a petition, Ejercito asked the Comelec to take a second look and reverse what he described as an erroneous and improper decision of the poll body’s First Division.

Ejercito said the First Division “gravely erred” in granting the petition of his rival, Edgar San Luis, to disqualify him from running in the last May elections.

“There are substantial and meritorious grounds, which merit the review, reconsideration and reversal of the challenged resolution of the honorable Commission (First Division) granting the petition of San Luis,” he said.

Ejercito said San Luis’ allegations that he gave out “orange cards” to convince people to vote for him should be considered an election offense and not as basis for disqualification.

The Laguna governor said the Comelec First Division does not have jurisdiction over the disqualification case, as he noted that he had already been proclaimed winner in the gubernatorial elections.

He said the disqualification case was prematurely and improperly filed and violated his right to due process.

Last Sept. 26, the poll body disqualified Ejercito for campaign overspending, noting he spent P6 million for television advertisements alone. The Comelec said Ejercito was allowed to spend only P4.5 million.
