Certificates of title to Piedad Estate cancelled
The Supreme Court recently upheld the dismissal of the lawsuit of certain occupants of a portion of the “Piedad Estate” for the cancellation of certificates of title over the subject property.
In its 14-page decision penned by Associate Justice Consuelo Ynares-Santiago, the High Court’s Third Division unanimously affirmed the Court of Appeals decision, which held that the said occupants are not real parties-in-interest.
Concurring in the decision were Justice Ma. Alicia Austria
The occupants, who were petitioners to the case, had sought for the cancellation of the subject certificates of title of the friar lands.
They alleged that such are spurious, fictitious, issued “under mysterious circumstances,” and the holders, including respondent Genuino Ice Co. Inc., were never in actual possession of the property involved.
In holding that the petitioners’ complaint did not state a valid cause of action, the High Court noted the petitioners had conceded the State’s ownership of the property by failing to pray that they be declared owners of the land in question but only to be adjudged as “bona fide occupants.” – Sandy Araneta
